International Arbitration

International arbitration is perhaps the leading dispute resolution mechanism for parties in different jurisdictions, and Deminor provides financing for both international commercial arbitration and investment treaty arbitration.

International arbitration
proceedings can be expensive

Funding from Deminor allows parties to pursue their claims without the burden of upfront costs. Arbitration funding can level the playing field and ensure that disputes are resolved on their merits rather than on the basis of financial resources. Funding also allows parties to mitigate the risks involved.

Deminor funds arbitration proceedings for a wide range of parties globally from SMEs to larger corporates, and its clients span a number of industries from construction and mining to pharmaceuticals and manufacturing.

Non-Recourse Financing

Funding is non-recourse, meaning clients will only repay the investment if their arbitration is successful. Deminor has no right to be repaid if the claim does not result in a recovery.

Risk Mitigation

Deminor’s funding allows clients to mitigate the financial risks associated with arbitration, protecting their assets and allowing them to focus their resources on their businesses rather than their disputes.

Since 1990, Deminor has been helping companies and investors monetise their legal claims, and Deminor has funded cases in 22 jurisdictions globally.

How does Deminor’s funding process work?

Case Evaluation

A client or its law firm can submit a request for funding to Deminor’s experienced case management team. They will carry out diligence and ask a number of questions to analyse the merits, the risks, and the economics of the case. The case management team will then seek the approval of Deminor’s Investment Committee to invest in an appropriate case.

Funding Approval

Upon approval, Deminor will enter into a funding agreement with the client to provide the necessary capital to cover some or all of the costs of the arbitration, including legal fees, expert witness fees, tribunal costs, disbursements, and administrative expenses. Deminor can also provide funding to cover the costs of an ATE insurance premium, or provide an indemnity, to cover the risk of adverse costs.

Arbitration Proceedings

With funding secured, the client can proceed confidently with their arbitration case, knowing that finances are no longer an obstacle and the risks have been mitigated.

Success and Receipt of Proceeds

In the event of a successful arbitration outcome, Deminor will receive reimbursement of its funding in addition to a pre-agreed success fee.
